Šipulová and Smekal on Transitional justice
Katarína Šipulová and Hubert Smekal contributed to Europe-Asia Studies with a piece on dilemmas faced by constitutional courts when adjudicating on transitional justice issues. Authors demonstrate that constitutional courts are able to use international human rights commitments strategically, depending on how it suits their understanding of a transition. Nevertheless, the influence of international human rights law strengthens over time and gradually prevails over transitional justice justifications.
