1 / 2 DISCIPLINARY CODE FOR STUDENTS OF THE FACULTY OF SOCIAL STUDIES, MASARYK UNIVERSITY (in the version effective from 1st September 2022) Part One Basic provisions Article 1 Subject of the regulation (1) The Disciplinary Code for students of the Faculty of Social Studies, Masaryk University (hereinafter referred to as the “Code”) are internal regulations of the Faculty of Social Studies, Masaryk University (hereinafter referred to as the “Faculty”) within the meaning of Sect. 33 para. 2(e) of Act No. 111/1998 Coll., on Higher Education Institutions and Amendment of Other Acts (Higher Education Act), as amended (hereinafter referred to as the “Act”). (2) Act No. 500/2004 Coll., the Administrative Code, as amended (hereinafter referred to as the “Administrative Code”) shall apply to the proceedings on a disciplinary offence in the event that this Code, the Disciplinary Code for students of Masaryk University (hereinafter referred to as the “Disciplinary Code of MU”) or the Act do not contain special regulation. (3) This Code supplements the Disciplinary Code of MU, which sets out disciplinary offences for MU students, regulates details on the hearing of disciplinary offences and disciplinary proceedings, including the Disciplinary Committee and its Rules of Procedure, as well as the rules for imposing sanctions for disciplinary offences. Article 2 Disciplinary offence (1) A disciplinary offence is an attributable breach of an obligation laid down by a legal regulation or an MU regulation, whereby such breach threatens or disrupts the interest, activity, or mission of the MU or any of its constituent parts. (2) Disciplinary offences are defined in detail in Article 2 of the Disciplinary Code of MU. Article 3 Disciplinary proceedings Details on the hearing of disciplinary offences and disciplinary proceedings are regulated by Part Two of the Disciplinary Code of MU. Article 4 Disciplinary Committee of the Faculty (1) The Disciplinary Committee of the Faculty (hereinafter referred to as the “Disciplinary Committee”) is a autonomous university body. (2) The Disciplinary Committee has 6 members. The term of office of a member of the Disciplinary Committee is 2 years from the date of their appointment. (3) The members of the Disciplinary Committee and their substitutes are appointed and removed by the Dean from among the members of the Faculty's academic 2 / 2 community after the prior approval of the Faculty's Academic Senate. The Dean cannot be a member of the Disciplinary Committee. (4) Half of the members of the Disciplinary Committee are students enrolled at the Faculty. Student members of the Disciplinary Committee must not be employed by MU. (5) Before the end of the term of office, membership of the Disciplinary Committee expires by removal in accordance with paragraph 3, by written resignation delivered to the Dean, or by expiry of membership of the relevant part of the Faculty’s academic community in the sense of paragraphs 3 and 4. Membership also expires upon the creation of an employment relationship in accordance with paragraph 4 of the second sentence. Article 5 Rules of Procedure of the Disciplinary Committee The Rules of Procedure of the Disciplinary Committee are regulated by Part Three of the Disciplinary Code of MU. Article 6 Delivery Delivery of documents in disciplinary proceedings is governed by Article 17 of the Disciplinary Code of MU. Article 7 Transitional provisions (1) Liability for disciplinary offences shall be assessed according to existing regulations if the action establishing liability occurred before the date of entry into effect of this Code; it will only be assessed according to this Code if it is more favourable for the student. (2) Proceedings initiated before the entry into effect of this Code shall be completed in accordance with this Code. (3) A Disciplinary Committee established before the entry into effect of this Code is considered a Disciplinary Committee established in accordance with this Code. Article 8 Final provisions (1) The Disciplinary Code for students of the Faculty of Social Studies, Masaryk University, as of 25 May 2017, is hereby cancelled. (2) This Code was approved pursuant to Sect. 27 para. 1(b) of the Act by the Academic Senate of the Faculty of Social Studies, Masaryk University, on 31 January 2022. (3) This Code was approved pursuant to Sect. 9 para. 1(b) of the Act by the Academic Senate of Masaryk University on 21 February 2022. (4) This Code enters into force on the date of its approval by the MU Academic Senate. (5) This Code enters into effect on 1 September 2022. prof.
